What changed
Every important change to our legal pages, in plain words. When something here affects you, we also show a notice in your dashboard and email you. Changes to fees, payouts, or what ByUs may recover from a creator’s earnings apply to existing accounts 30 days after they are posted; other changes apply when posted. The full documents always win if this summary and a document ever differ.

New ways to support creators, clearer dispute rules, and how we tell you about changes
Terms of Service
- Fans can now buy a single members-only post or a bundle of posts, pay to send a creator a message, and book a 1:1 video call. For paid messages and calls, your card is only held at first and is charged only if the creator replies or shows up for the call.
- New rules for messages, calls and members-only content: no sexual content or adult services, no recording or sharing without permission, no paying a creator outside ByUs, and members-only photos and videos are for your personal use and show a watermark with your name.
- Removing, cropping, blurring or getting around the watermark or download protections is a serious violation, and the account can be closed right away.
- Creator fees now follow monthly rates set by the previous month’s sales: 13% under $1,000, stepping down to 9% at $5,000 or more. Founding creators pay 10%, or the monthly rate when it is lower.Applies to existing accounts from November 2, 2026
- A founding creator spot and its rate can end for repeated non-delivery.Applies to existing accounts from November 2, 2026
- Every section now starts with a short “In short” summary in plain words.
- Account rules spelled out: one person per account, accounts can’t be sold or transferred, U.S. sanctions limits apply, and creators must be based where ByUs pays out (the United States today).
- For creators: when payouts can be paused or partly held (to cover refunds or disputes, prevent fraud, missing tax or identity information, or legal or processor requirements), how tax reporting and withholding work, and that conduct outside ByUs can matter when it creates real legal, safety, or payment risk.Applies to existing accounts from November 2, 2026
- For fans: prices are in U.S. dollars with any required sales tax added before you pay, a tier’s price never goes up after you join, what happens if a renewal payment fails, and when you might lose access to something you paid for.
- New sections on legal claims caused by your own posts or conduct, services you connect (like Google sign-in or Discord), who owns what you post and the ByUs name, optional text alerts, and general terms such as notices by email and what happens if ByUs is sold.
- Rewrote section 9 (limits on liability) in plainer words, with a short summary at the top. If you lose money because of ByUs, the most ByUs owes is what ByUs earned from your use over the past 12 months, or $100 if that’s more. ByUs isn’t responsible for a creator’s unfulfilled promises or for conflicts with your other agreements, but this never reduces the refunds in section 4.
- You can now ask for a refund with the Request a refund button on your dashboard. ByUs decides refund requests, not the creator.
- Section 11 now explains how we tell you about changes: a notice on your dashboard, an email for important changes, and 30 days’ notice before changes to fees or payouts apply to existing accounts.
Creator Agreement
- If you offer paid messages or video calls, you need to reply to and attend what supporters pay for, or cancel so they aren’t charged.
- If a dispute is lost because you didn’t provide what was paid for, ByUs may recover the bank’s dispute fee and the card processing cost from your earnings, along with your share of that payment. Never when the dispute is won, you delivered, or it was fraud you couldn’t prevent.Applies to existing accounts from November 2, 2026
- Repeated lost disputes or confirmed complaints for not delivering can lead to removed offers, held or delayed payouts, suspension, or losing your founding spot and its rate.Applies to existing accounts from November 2, 2026
- Once you download member information, you are responsible for it, and any email you send to more than one member needs a working unsubscribe link.
- If you connect your own domain to your page, it must be yours to use, you keep it registered and set up, and ByUs may disconnect it if it misleads people or breaks the rules.
- If you connect Automations, member names, emails and tiers sent to your tools follow the same rules as a downloaded member list. Supporter credits only name members who agreed, and you stop naming anyone who leaves or changes their mind.
- New section 9 explains how we tell you about changes and asks you to confirm important ones in your dashboard.
Content Policy
- The rules now also cover private messages, paid messages and video calls.
Privacy Policy
- Explains private messages: we don’t read them unless one is reported, for safety or fraud checks, or when the law requires it.
- Explains video calls (run by our video provider and never recorded), the watermark on members-only media, and the two small cookies that remember how you found a creator and which invite link you used.
- We’ll now email account holders about important changes to this policy.
- Creators can have member details sent to tools they connect, like an email newsletter service. A new setting, off unless you turn it on, lets creators you support thank you by name in their credits.
